Complaints – Disputes
Consumer mediation: In accordance with the provisions of Article L616-1 of the Consumer Code relating to amicable settlements of disputes, WEST YAHT BROKER has MEDICYS as consumer mediator. To implement the
Consumer mediation, it is sufficient that the customer is a consumer, that he sends his request to the mediator either by mail to the following address: MEDICYS – 73 Boulevard de Clichy – 75009 PARIS or directly via an online form on the site https://app.medicys.fr/?proId=b3796296-5804-4331-9107-2595225e8bbe by providing proof that he has already tried to resolve the dispute encountered with the company without success.
Said mediation is free for the consumer, the fees of the independent mediator being covered by WEST YAHT BROKER according to a fixed rate.
In the event of failure to resolve the dispute amicably and in the event of a dispute between two professionals, jurisdiction is granted to the commercial court of La Rochelle.
In the event of a dispute by an individual, the latter will have the choice between the district court or high court of the location of the registered office of the E-NITIATIVES GROUPE agency or the place where the service is provided.
The reference language for the settlement of any disputes is French.

In the event of exercising one of these rights, the user must send WEST YAHT BROKER the information necessary for their identification: surname, first name, email address and possibly their postal address. Due to the complexity of the request and/or the number of requests, this period may be extended to two (2) months on the condition that WEST YAHT BROKER informs the user within one (1) month of receipt of the request of the reasons for the postponement.
If WEST YAHT BROKER does not respond to the request made by the user, WEST YAHT BROKER will inform the user no later than one (1) month from receipt of the request of the reasons for its inaction.
WEST YAHT BROKER informs users of their right to file a complaint with the CNIL.
8/ Retention period
The personal data of users collected is kept for a period of 1 year from the end of the execution of the IT contract, the provision of service or the sale of IT equipment notwithstanding the request for deletion of their data, except with regard to data that WEST YAHT BROKER would need to keep as proof, for legal or administrative purposes or in accordance with the legislation in force.
As an exception to the paragraph above, users are informed that cookies are stored for a maximum period of one (1) year after their first deposit in the user's terminal equipment.
